Terms of Service

By creating an account or using AccountSmarty (the "Service"), you agree to these Terms of Service. If you are using the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for that organization.

If you do not agree to these Terms, please do not use the Service.

AccountSmarty is an online double-entry accounting tool. It lets you keep a chart of accounts, record and approve transactions, import bank statements and reports, and view financial summaries.

We may improve, change or remove features from time to time. We will try to give notice of significant changes that reduce the core functionality you rely on.

• You must provide accurate registration details and keep them up to date.
• You are responsible for keeping your password confidential and for all activity under your account.
• You must tell us promptly if you suspect unauthorized access to your account.
• You must be at least 18 years old, or the age of majority where you live, to use the Service.

You keep ownership of the financial data, statements and files you upload ("Your Data"). You give us a limited right to store, process and display Your Data only as needed to provide the Service to you.

When you import bank statements or transaction reports, the Service reads the file, suggests categories and accounts, and shows you a review screen. Suggestions are automated and can be wrong. You are responsible for reviewing and approving transactions before relying on them.

You confirm that you have the right to upload the files you import, including any personal information of other people that they contain.

You agree not to:

• use the Service for anything unlawful, fraudulent or that infringes the rights of others;
• attempt to gain unauthorized access to the Service, other accounts or our systems;
• upload malware, or interfere with or disrupt the Service or its infrastructure;
• reverse engineer, copy or resell the Service except as we expressly allow;
• use automated means to extract data from the Service beyond the features we provide.

AccountSmarty is a software tool. Nothing in the Service is accounting, tax, legal or investment advice. Reports and balances reflect the data entered or imported into your account. You are responsible for the accuracy of your records and for meeting your own tax and reporting obligations. Please consult a qualified professional where needed.

The Service, including its software, design, text and branding, belongs to AccountSmarty and its licensors and is protected by intellectual property laws. Except for the right to use the Service under these Terms, we grant you no rights to it.

If you send us feedback or suggestions, we may use them without restriction or compensation.

We work to keep the Service available and secure, but we do not guarantee it will be uninterrupted or error-free. We may suspend the Service for maintenance or security reasons. You are encouraged to export and keep your own copies of important records.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if your use puts the Service or other users at risk.

After termination we will handle Your Data as described in our Privacy Policy. Sections that by their nature should survive termination, such as ownership, disclaimers and limits of liability, will continue to apply.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose, accuracy of automated categorization, and non-infringement.

To the maximum extent permitted by law, AccountSmarty will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, where appropriate, notify you in the Service or by email. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the jurisdiction in which AccountSmarty is established, without regard to conflict-of-law rules. Disputes will be handled by the courts of that jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere.
